EXCLUSION FROM TAIS

LIMITED WARRANTY PROGRAMS

This standard Toshiba America Information Systems, Inc. ("TAIS") United States Limited Warranty, optional TAIS warranty programs and all extensions thereof do not include service, repair, or replacement to correct any damage caused by improper installation, improper connection with any peripheral, external electrical fault, accident, disaster, misuse, abuse or modifications to the computer not approved in writing by TAIS. All other express or implied warranties, including the implied warranty of merchant ability and fitness for a particular purpose, are hereby disclaimed.

IF THIS PRODUCT IS NOT IN GOOD WORKING ORDER AS WARRANTED, THE SOLE AND EXCLUSIVE REMEDY SHALL BE REPAIR OR REPLACEMENT. IN NO EVENT SHALL TAIS, TOSHIBA CORPORATION, OR ANY DEALER, DISTRIBUTOR, RESELLER, OR AUTHORIZED SERVICE PROVIDER/PARTNER BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT. THIS LIMITATION APPLIES TO DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, DIRECT OR INDIRECT DAMAGES, LOST PROFITS, LOST SAVINGS OR OTHER SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES WHETHER FOR BREACH OF CONTRACT, TORT OR OTHERWISE, OR WHETHER ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF TAIS, TOSHIBA CORPORATION, OR ANY DEALER, DISTRIBUTOR, OR AUTHORIZED SERVICE PROVIDER/PARTNER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ANY CLAIM BY ANY OTHER PARTY. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY OR MAY NOT APPLY TO YOU. TOSHIBA AUTHORIZED DEALERS, DISTRIBUTORS, AND AUTHORIZED SERVICE PROVIDERS/PARTNERS, WHETHER DOMESTIC OR INTERNATIONAL, MAY BE CHANGED, ADDED OR DELETED, WITHOUT NOTICE OR LIABILITY. TAIS DISCLAIMS ALL LIABILITY ARISING OUT OF THE CHANGE, ADDITION OR DELETION OF ANY DEALER, DISTRIBUTOR OR AUTHORIZED SERVICE PROVIDER/PARTNER TO THE PROGRAM. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO SUCH LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

During the standard or extended warranty period(s) TAIS will, at no additional charge to you, repair or replace defective parts with new or reconditioned parts at its option. Reconditioned parts will be equal in performance to original parts. All original parts and Products replaced by TAIS or its Authorized Service Providers, become the property of TAIS. You are responsible for payment, at current rates, for any service, repair, or replacement outside the scope of this Limited Warranty.

Acceptance by TAIS Authorized Service Provider/Partner or by a TAIS authorized agent does not mean that your Product will be repaired without cost to you. If TAIS's Authorized Service Provider/Partner determines that the repairs required are not covered by your standard Limited Warranty or any optional service program or extension thereof, you will be notified. If you authorized repairs, you will be responsible for paying the current standard repair rate.

PRE-EXISTING FAILURES ARE NOT COVERED UNDER ANY TAIS OPTIONAL OR EXTENDED SERVICE PROGRAMS. PRIOR ENROLLMENT IS REQUIRED IN ANY OPTIONAL OR EXTENDED SERVICE PROGRAM AND THE FEE WILL NOT BE PRORATED.

TAIS reserves the right to alter or cancel these programs at any time without prior notice and to request Product proof of purchase to validate warranty eligibility.

DATA STORAGE MEDIA

The only effective protection for the data stored in a computer, such as on a hard disk, is a regular discipline of backing up that data. TAIS and its representatives accept no responsibility for any software programs, data or information stored on any media or any part of any Product returned to TAIS or its representatives for repair.

TAIS and its representative will make every effort to return your Product with all your software programs, data, or information stored on any media intact. HOWEVER, IF DURING THE REPAIR OF THE PRODUCT THE CONTENTS OF THE HARD DISK OR DATA STORAGE MEDIA ARE ALTERED, DELETED, OR IN ANY WAY MODIFIED, TAIS OR ITS REPRESENTATIVES ARE NOT RESPONSIBLE WHATSOEVER. It remains solely your responsibility to assure the integrity of any software programs, data, or information stored on any storage media or any part of any product returned for repair to TAIS, its dealers, distributors, resellers, or Authorized Service Providers/Partners.

PRE-INSTALLED SOFTWARE

Even though TAIS has reviewed some or all of the pre-installed software and documentation, TAIS makes no warranty or representation, either expressed or implied, with respect to software, its quality, performance, merchantability, or fitness for a particular purpose. Nor does TAIS warranty that the functions contained in this software will meet your requirements or that the operation of this software will be uninterrupted or error free. As a result, unless otherwise stated in writing, this software is sold "as is." Should this software prove defective, you, the purchaser, are assuming the entire risk as to its quality and performance as well as any costs associated with servicing, repairing, or correction.

In no event will TAIS, its dealers, distributors, resellers, or Authorized Service Providers/Partners be liable for direct, indirect, special, incidental, or consequential damages resulting from any defect in the software or its documentation, even if advised of the possibility of such damages. In particular, TAIS or its representatives shall have no liability for any programs or data stored or used with TAIS Products, including the costs of recovering such programs or data.

Thank you for your purchase of a Toshiba Portable Personal Computer. This booklet provides you with a complete description of all standard and optional warranty and service programs. Please familiarize yourself with this information and mail in your Product Registration form as soon as possible. T-PLAN

Under our standard United States one year Limited Warranty, T-PLAN, Toshiba America Information Systems, Inc. (TAIS) warrants that this TAIS Portable Personal Computer*, including the battery, accessories, and/or peripherals ("Products") you have purchased new from TAIS or from a United States TAIS authorized reseller are free from defects in materials or workmanship under normal use for a period of one year.

The warranty period began the day you purchased a new Product. Either your sales receipt as proof of purchase or an official TAIS Warranty Confirmation Label is required to receive T-PLAN warranty service in the United States. For your convenience and to expedite warranty service, Product registration is strongly recommended. To register with TAIS, return your completed Product Registration form as soon as possible in the envelope provided. Optional service programs and extended warranty are also available to provide additional convenience, security, and protection (see below).

When your Product Registration form has been received, a personalized TAIS Warranty Confirmation Label will be mailed to you. This TAIS Warranty Confirmation Label provides validation that your Product is under warranty and details the type of warranty programs and coverage period for which you are eligible. Please apply your Warranty Confirmation Label to your Product per the instructions received with the label. If you choose not to register your Product, you must provide a copy of your proof of purchase to receive service under your Limited Warranty.

To received TAIS warranty service in the United States, call TAIS at 1-800-999-4273. If your problem cannot be resolved over the phone and warranty service is required, you will be referred to the nearest TAIS Authorized Service Provider. It is your responsibility to pack, insure, and deliver or ship your Product to the TAIS Authorized Service Provider. TAIS or its representatives cannot assume any responsibility or liability for loss or damage to your Product which may occur during transit.

* Preinstalled software excluded from the TAIS standard Limited Warranty.

T-SUPPORT

For expert Product information and support, call T-SUPPORT at 1-800-999-4273. T-SUPPORT provides you with toll-free technical, operational and software information from anywhere in the United States. Additional information is also available from T-SUPPORT through the TAIS AUTOFAX program at 714-583-3800, bulletin board service (BBS) at 714-837-4408, and the CompuServe Toshiba Forum (enter "Go TOSHIBA" at any system prompt).

T-WORLD

The TAIS WORLD program provides you with Limited Warranty service at no additional cost in more than twenty (20) countries outside of the United States. To be eligible for this valuable service, you must register your Product with TAIS by completing and returning your Product Registration form. When your Product Registration form has been received, a personalized TAIS Warranty Confirmation Label will be mailed to you. This TAIS Warranty Confirmation Label provides validation that your Product is under warranty and eligible for T-WORLD. Please apply your Warranty Confirmation Label to your Product per the instructions received with

the label. To receive T-WORLD Limited Warranty Service outside of the United States, a TAIS Warranty Confirmation Label must be attached to your Product.International Warranty Service is available only through the participating Authorized Service Providers whose telephone numbers are listed on the TAIS Warranty Confirmation Label. For a list of participating countries call TAIS AUTOFAX at 714-583-3800 and enter document number 89000.

To receive T-WORLD warranty service in one of the listed countries, please call the appropriate phone number displayed on your Warranty Confirmation Label. It is your responsibility to pack, insure, and deliver or ship your Product to the International Authorized Service Provider. TAIS or the International Authorized Service Provider cannot assume any responsibility or liability for loss or damage to your Product during transit.

T-PAK

The TAIS T-PAK program, our optional prepaid packaging and shipping service, provides convenient access to TAIS Authorized Service Partners throughout the United States. For a small annual fee (see your Product Registration form), any one of the nearly 2000 participating Mail Boxes, Etc. locations will pack, insure and ship your Product overnight to a TAIS Premier Authorized Service Partner at no cost to you. The Premier Authorized Service Partners employ TAIS-certified technicians, stock genuine TAIS parts, and maintain the highest level of customer satisfaction. Typically, service is completed by Premier Authorized Service Partners in two working days or less. Upon completion of service, your Product will be shipped to your prepaid via overnight air freight. Once enrolled, you may use T-PAK as often as necessary.

To enroll, complete the T-PAK section of the Product Registration form. Upon receipt by TAIS of your Product Registration form, you will be mailed a T-PAK confirmation letter, a TAIS Warranty Confirmation Label, and a preprinted Mail Boxes, Etc. work order. The toll free number for the nearest Mail Boxes, Etc. location is included with the work order. T-PAK benefits begin the day you receive your T-PAK confirmation letter. You may add T-PAK coverage to your standard Limited Warranty and extend coverage for up to two additional years if you purchase T-PLUS.

For service, just take your Product and the preprinted work order to the nearest Mail Boxes, Etc. - and they'll do the rest. TAIS T-PAK is a wise addition to your warranty program. T-PAK service is only available within the United States.

T-SITE

The TAIS T-SITE program provides warranty service at your location and eliminates the need for you to package, insure, and ship your Product to obtain service. For an annual fee (see your Product Registration form), you can have a TAIS-certified technician dispatched directly to you. Typical T-SITE response time is the next business day. T-SITE service available within a 100 mile radius of most major U.S. metropolitan areas. For service beyond 100 miles please call 1-800-999-4273 for details of our T-CARE program.

To enroll, complete the T-SITE section of the Product Registration form. You will be mailed a TAIS Warranty Confirmation Label that will indicate your T-SITE eligibility. T-SITE coverage begins with receipt of your Warranty Confirmation Label. You may add T-SITE coverage to your standard Limited Warranty and extend T-SITE for up to two additional years if you purchase T-PLUS.

To receive warranty service under T-SITE, call 1-800-999-4273. If your problem cannot be resolved over the phone and service is required, a TAIS-certified technician will be dispatched directly to you. Save time and effort with this convenient program. T-SITE service is only available within the United States.

T-SCREEN

The TAIS T-SCREEN program provides you with peace of mind against accidental damage to your computer screen. With T-PLAN, the TAIS standard Limited Warranty, your computer screen is covered against

manufacturing defects in materials and workmanship. However, under T-PLAN, if your computer screen is accidentally cracked or broken, it must be replaced at your expense. Your computer screen is one of the most complex and technologically advanced components of your portable computer. Once cracked or broken, flat-panel screens are not repairable-they must be replaced. The replacement costs of these complex components can approach the total cost of your portable computer.

Under T-SCREEN, one annual enrollment fee provides you with protection against the costs of replacing a cracked or broken screen. If your screen becomes damaged, this program enables you to replace your screen free of charge up to two times during a one year period. If your screen is damaged more than two times during a one year period, you will be billed 50% of the published retail price of the replacement screen, per occurrence, by TAIS. You may add T-SCREEN coverage to your standard Limited Warranty and extend coverage for up to two additional years if you purchase T-PLUS.

To enroll, complete the T-SCREEN section of the Product registration form. You will be mailed a TAIS Warranty Confirmation Label indicating your T-SCREEN eligibility. T-SCREEN coverage begins with receipt of your Warranty Confirmation Label. To receive warranty service under T-SCREEN, please call 1-800-999-4273. T-SCREEN service is only available in the United States.

T-PLUS

If you desire the protection and convenience of warranty coverage which extends beyond the standard one year T-PLAN and T-WORLD Limited Warranty, then TAIS T-PLUS is for you. For an additional fee, T-PLUS allows you to extend your one year T-PLAN, T-WORLD and T-SUPPORT Limited Warranty an additional two years (computer batteries excluded).

If you extend your standard T-PLAN Limited Warranty with T-PLUS, then, for an optional additional fee, any additional service programs any also be extended for up to two additional years. To enroll in the T-PLUS extended warranty program, fill in the T-PLUS section of the Product Registration form. T-PLUS coverage only applies to your Toshiba portable personal computer and any accessories originally packaged or bundled with your computer (computer batteries excluded).
